1. Agreement to These Terms
These Terms of Service ("Terms") govern your access to and use of the HCIA platform, websites, and related services (collectively, the "Service"), provided by HCIA – Human Capital Intelligence Agent ("HCIA", "we", "us", or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
2. Definitions
- Recruiter — a user or organisation that uses the Service to post roles, screen candidates, and manage hiring.
- Candidate — an individual who applies to a role or whose information is processed through the Service.
- Account — a registered account used to access the Service.
- Content — any data, text, files, CVs, questionnaire responses, or other materials submitted to the Service.
3. Eligibility and Accounts
You must be at least 16 years old to use the Service. You are responsible for:
- Providing accurate account information and keeping it current;
- Maintaining the confidentiality of your login credentials;
- All activity that occurs under your Account.
Notify us promptly of any unauthorised use of your Account. We may refuse, suspend, or terminate Accounts where these Terms are breached.
4. The Service
HCIA provides AI-assisted hiring tools, which may include:
- AI CV screening with evidence-backed fit scores;
- AI video interview assessment;
- Recruitment pipeline management and automation;
- Branded careers pages;
- Recruitment analytics and reporting.
We may add, change, or remove features over time. Some features are available only on certain plans.
5. Subscriptions, Fees, and Payment
Certain features require a paid subscription. Plan features and pricing are described on our pricing page and at checkout.
- Fees are billed in advance on a recurring basis (monthly or annually) unless stated otherwise.
- Except where required by law, fees are non-refundable.
- We may change pricing effective on renewal, with reasonable prior notice.
- You authorise us and our payment processors to charge your chosen payment method for applicable fees and taxes.
- Non-payment may result in suspension or termination of paid features.
6. Acceptable Use
You agree not to:
- Use the Service unlawfully, or in violation of any applicable employment, data protection, or anti-discrimination law;
- Upload Content you do not have the right to share, or that infringes the rights of others;
- Attempt to reverse engineer, scrape, overload, probe, or disrupt the Service or its security;
- Use the Service to build a competing product, or resell or sublicense it without authorisation;
- Rely on AI outputs to make unlawful or discriminatory hiring decisions.
7. Candidate Data and Recruiter Responsibilities
Where a Recruiter uploads or processes Candidate data through the Service, the Recruiter acts as the data controller and HCIA acts as a data processor on the Recruiter's behalf, in accordance with our Privacy Policy and any applicable Data Processing Agreement.
Recruiters are responsible for:
- Having a valid lawful basis to collect and process Candidate data;
- Providing any required notices to Candidates;
- Limiting questionnaire questions to what is lawful, necessary, and proportionate for the role;
- Making final hiring decisions and complying with all applicable laws.
8. AI-Assisted Features
The Service uses AI to assist with screening and assessment. You acknowledge that:
- AI outputs are decision-support tools, not final decisions. HCIA does not make automated final hiring decisions; a human reviews outputs before any hiring action is taken.
- Directly identifying personal information is redacted before Content is processed by AI models, as described in our Privacy Policy.
- AI outputs may contain errors and should be independently reviewed. You are responsible for how you use them.
9. Intellectual Property
The Service — including its software, design, branding, and content (excluding your Content) — is owned by HCIA and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service. All rights not expressly granted are reserved.
10. Your Content
You retain ownership of the Content you submit. You grant HCIA a worldwide, non-exclusive licence to host, process, and use your Content solely to provide and improve the Service, consistent with our Privacy Policy. You are responsible for the accuracy and legality of your Content.
11. Confidentiality
Each party may access confidential information of the other. Each party agrees to protect such information and to use it only as necessary to perform under these Terms, except where disclosure is required by law.
12. Third-Party Services
The Service may integrate with or link to third-party services (for example, login providers, payment processors, and analytics). We are not responsible for third-party services, and your use of them is governed by their own terms.
13. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. To the maximum extent permitted by law, we do not warrant that the Service will be uninterrupted or error-free, or that AI outputs will be accurate or suitable for any particular hiring decision.
14. Limitation of Liability
To the maximum extent permitted by law, HCIA and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid to us in the twelve (12) months before the event giving rise to the claim, or (b) USD 100.
15. Indemnification
You agree to indemnify and hold HCIA harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your breach of these Terms or applicable law.
16. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or where required by law. On termination, your right to use the Service ends; provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and indemnification — survive. Data handling after termination follows our Privacy Policy.
17. Changes to the Service and Terms
We may modify the Service or these Terms from time to time. For material changes to these Terms, we will provide reasonable notice (for example, by email or a notice on the platform) and update the "Last Updated" date above. Your continued use of the Service after changes take effect constitutes acceptance.
18. Governing Law and Disputes
These Terms are governed by the laws of the United Arab Emirates, without regard to its conflict-of-laws rules. You agree to submit to the jurisdiction of the competent courts located in the United Arab Emirates — except where applicable mandatory consumer or data-protection law grants you rights in your country of residence.
19. General
- Entire agreement: These Terms, together with the documents referenced in them, form the entire agreement between you and HCIA regarding the Service.
- Severability: If any provision is held unenforceable, the remaining provisions remain in full effect.
- Waiver: Our failure to enforce a provision is not a waiver of it.
- Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
